1. Define Your Budget and Financing Options

Before searching, decide on your budget, including the purchase price, taxes, legal fees, and other costs.

Mortgages: Non-residents can usually finance up to 70% of the property value through Spanish banks.
Currency considerations: Plan for transfers and currency exchange to avoid surprises.

2. Choose the Right Property

Marbella offers a wide variety of properties, from luxury villas to modern apartments, townhouses, and penthouses. Consider:

  • Location: Close to golf courses, beaches, schools, or city center.
  • Type: New build or resale? Modern or classic style?
  • Lifestyle needs: Private pool, garden, security, or proximity to social hubs.

3. Legal Requirements Made Easy

With MGA, legal complexities are simple. Our in-house lawyer ensures everything is in order:

  • Obtain your NIE Number (required for all property purchases).
  • Open a Spanish bank account for payments, taxes, and utilities.
  • Verify that the property is free from debts, liens, or planning restrictions.

4. Making an Offer and Reservation

Once you find your property, your MGA agent will help you:

  • Make an official offer.
  • Sign a reservation contract with a small deposit (typically 3–5%).

5. Due Diligence

Our in-house lawyer carefully checks:

  • Property title and registration.
  • Existing debts, mortgages, or community fees.
  • Building permits and licenses.

6. Private Purchase Contract

After due diligence, you’ll sign a private contract and usually pay 10% of the property price. This makes the purchase legally binding.

7. Completion at the Notary

The final deed (Escritura de Compraventa) is signed at a notary office. Remaining payments are made, and ownership is officially transferred.

8. Taxes and Fees

  • Property Transfer Tax (ITP): 7–10% for resale properties.
  • VAT (IVA): 10% for new builds.
  • Notary & Land Registration Fees: 0.5–1% each.
  • Legal Fees: Typically 1–2% of the purchase price (handled directly by MGA’s in-house lawyer).

9. Registration and Ongoing Costs

  • Your property is registered in your name by our in-house lawyer.
  • Annual costs include IBI property tax, community fees, and utility bills.
